SECTION 01
Introduction & Acceptance
By accessing or using FIU TECH's services, you agree to be bound by this agreement.
Binding Agreement: These Terms & Conditions constitute a legally binding agreement between you and FIU TECH Inc., located at 2967 Dundas Street West, Unit #368 B, Toronto, ON, M6P 1Z2.
Scope: This agreement governs your use of our website, services, IT support, hardware products, cloud solutions, and any related digital offerings provided by FIU TECH.
Updates: FIU TECH reserves the right to update these terms at any time. Continued use of our services after changes are published constitutes your acceptance of the updated terms.
Eligibility: You must be at least 18 years of age and have the legal authority to enter into contracts on behalf of yourself or your organization.

FIU TECH Note: By placing an order, requesting a service, or creating an account with FIU TECH, you confirm that you have read, understood, and accepted these terms in full.

SECTION 02
Services & Products
What FIU TECH offers and the terms that govern each service.
Service Offerings: FIU TECH provides IT hardware supply, software support, cybersecurity consulting, cloud services, website design, web & mobile app development, and IT parts for commercial and enterprise clients across Canada.
Product Availability: All products are subject to availability. FIU TECH reserves the right to limit quantities, discontinue products, or modify product specifications without prior notice.
Service Quotes: Service quotes are valid for 30 days from the date of issue unless otherwise stated. Prices are in Canadian dollars (CAD) and subject to applicable taxes.
Remote Access via TeamViewer: FIU TECH provides remote IT support exclusively through TeamViewer software. By accepting remote support, clients acknowledge that the security, encryption, and data protection of the TeamViewer connection are governed solely by TeamViewer GmbH's terms and privacy policy. FIU TECH assumes no responsibility for any security incidents, data exposure, or connectivity issues arising from the use of the TeamViewer platform.
Third-Party Software Exclusion: FIU TECH technicians will only diagnose, configure, and support software that is within our approved service scope. If a client has proprietary, industry-specific, or third-party software installed on their devices — including pharmacy management systems, accounting platforms, ERP systems, or any other vendor-specific applications — FIU TECH will not access, manage, modify, or troubleshoot such software. Full responsibility for the configuration, licensing, security, and operation of third-party software remains exclusively with the client and the respective software vendor.
Pharmacy Products: Products listed under our Pharmacy category, including toner cartridges, drum units, and fuser kits, are supplied as compatible or manufacturer-sourced consumables. Performance may vary by device model.

FIU TECH Note: FIU TECH is committed to delivering high-quality products and services. If a product does not meet your expectations, our 2-month return policy ensures a smooth resolution.

User Responsibilities
Your obligations when using FIU TECH services or placing orders.
Accurate Information: You agree to provide accurate, current, and complete information when placing orders, requesting services, or communicating with our team. Providing false information may result in order cancellation.
Account Security: If you create an account with FIU TECH, you are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account.
Lawful Use: You agree to use our products and services only for lawful purposes and in compliance with all applicable Canadian federal and provincial laws and regulations.
Respectful Communication: All communication with FIU TECH staff must be professional and respectful. FIU TECH reserves the right to refuse service to clients who engage in abusive, threatening, or inappropriate behaviour.
SECTION 04
Acceptable Use Policy
What you may and may not do with FIU TECH products and services.
Permitted Use: FIU TECH products and services are intended for legitimate business, professional, and personal computing purposes in compliance with applicable law.
Prohibited Activities: You may not use FIU TECH services to engage in illegal activity, distribute malware or harmful content, reverse-engineer our proprietary systems, or violate the intellectual property rights of any third party.
Resale Restrictions: Resale of FIU TECH-supplied hardware or services requires prior written authorization. Unauthorized resale may result in immediate termination of your account and legal action.
Network Equipment: Networking hardware sold by FIU TECH must be configured and deployed in accordance with applicable wireless and telecommunications regulations in Canada.

SECTION 05
Payments & Refunds
Payment terms, accepted methods, and our return and refund policy.
Payment Methods: FIU TECH accepts major credit and debit cards, e-transfers, and authorized purchase orders for qualified business accounts. Online card payments are securely processed through Stripe, a PCI-DSS Level 1 certified payment provider. FIU TECH does not store your card details.
Pricing: All prices are listed in Canadian dollars and are subject to applicable HST/GST. FIU TECH reserves the right to correct pricing errors and will notify you before processing affected orders.
2-Month Return Policy: Products may be returned within 60 days of delivery for a full refund or exchange, provided they are returned in their original manufacturer packaging, including all accessories, documentation, and inserts that were included at the time of delivery. Returns submitted without the original box or with damaged, missing, or substituted packaging will not be accepted. Prior to every shipment, FIU TECH performs a quality inspection and functional test on each product to ensure it is in full working condition before it reaches you. Following the test, the product is resealed and secured with a unique barcode and hologram sticker at the time of dispatch. To be eligible for a return, the product must have the original barcode and hologram intact and undamaged. Any return request where the barcode or hologram has been removed, altered, or tampered with will not be accepted. Please note: the return policy applies to electronic products only (laptops, networking equipment, monitors, printers, phones, etc.). Toner cartridges, imaging units, drum units, and other printer consumables are not eligible for return once the order has been placed, due to their consumable nature.
Service Refunds: Refunds for service labour are evaluated case-by-case. If a service issue was not resolved to your satisfaction, contact us within 14 days and we will work to find a fair resolution.

SECTION 06
Delivery & Shipping
How and when your orders are shipped across the GTA and Canada.
Same-Day GTA Delivery: Orders placed before 4:00 PM on business days qualify for free same-day delivery within the Greater Toronto Area. Delivery times may vary based on location and product availability.
Canada-Wide Free Shipping: All orders ship free anywhere in Canada, regardless of order size or destination. Standard delivery typically takes 2–5 business days outside the GTA.
Delivery Risk: Risk of loss or damage transfers to you upon delivery confirmation. FIU TECH is not responsible for delays caused by courier services, weather events, or circumstances beyond our control.
Damaged Shipments: If your order arrives damaged, contact us within 48 hours of delivery with photos of the damage. We will arrange a replacement or refund at no additional cost to you.

Privacy & Data
How FIU TECH collects, uses, and protects your personal information.
Data Collection: FIU TECH collects personal information such as name, email, phone number, and address solely for the purpose of processing orders, providing services, and communicating with you.
PIPEDA Compliance: FIU TECH complies with the Personal Information Protection and Electronic Documents Act (PIPEDA). We do not sell, trade, or share your personal data with third parties without your consent, except as required by law.
Cookies: Our website uses essential cookies to improve your browsing experience. No personally identifiable data is collected through cookies without your knowledge.
Data Retention: Your personal information is retained only as long as necessary to fulfil the purposes for which it was collected or as required by applicable law.

Intellectual Property
Ownership of content, branding, and creative materials.
FIU TECH Content: All content on the FIU TECH website — including logos, designs, text, graphics, and software — is the exclusive property of FIU TECH Inc. and is protected under Canadian copyright law.
Limited License: You are granted a limited, non-exclusive, non-transferable license to access and use the FIU TECH website for personal and business purposes. Any unauthorized reproduction or use of our content is prohibited.
Client Work: For web design and app development projects, intellectual property rights of final deliverables are transferred to the client upon full payment of the agreed invoice, unless otherwise specified in writing.

SECTION 09
Limitation of Liability
The extent of FIU TECH's legal responsibility for damages or losses.
No Consequential Damages: FIU TECH shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our products or services, even if we have been advised of the possibility of such damages.
Maximum Liability: In no event shall FIU TECH's total liability to you exceed the amount you paid for the specific product or service giving rise to the claim in the 12 months preceding the incident.
Service Disclaimer: While FIU TECH strives for excellence in every service engagement, we do not warrant that our services will be uninterrupted, error-free, or meet every specific requirement of your environment.

FIU TECH Note: These limitations are reasonable and reflect the realities of technology services. Our commitment to quality means we will always work to make things right, within these boundaries.

SECTION 10
Termination
Conditions under which FIU TECH may suspend or terminate service.
Termination by FIU TECH: FIU TECH reserves the right to suspend or terminate your access to services at any time if you are found to be in violation of these terms, engaging in fraudulent activity, or causing harm to our business or other clients.
Termination by Client: You may discontinue use of FIU TECH services at any time. Outstanding invoices must be settled in full prior to account closure.
Effect of Termination: Upon termination, your rights to access FIU TECH services cease immediately. Any provisions of these terms that by their nature should survive termination — including payment obligations, intellectual property rights, and liability limitations — shall remain in effect.

Governing Law: These Terms & Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Dispute Resolution: Any disputes arising from these terms shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Toronto, Ontario.
Entire Agreement: These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and FIU TECH Inc. regarding your use of our services.
